These Terms of Use govern your use of nha-trang.vn (the "Site"), operated by CÔNG TY TNHH BESPALOV IN VIETNAM (Số ĐKKD/MST: 4201947140), Lô 21 LK8-5 đường số 16, khu đô thị Mỹ Gia gói 8, Xã Vĩnh Thái, Thành phố Nha Trang, Tỉnh Khánh Hòa, Việt Nam (the "Operator", "we"). By using the Site you agree to these Terms and to our Privacy Policy; if you do not agree, please do not use the Site.
What this Site is
nha-trang.vn (the "Site") is an information and discovery portal about the city of Nha Trang: a structured catalogue of places, community classifieds, rentals, jobs, events, courses, tours and activities, a news & city-digest section, and a community discussion section. We collect, structure, translate and present information that already exists in public sources — including social networks, messaging platforms, mapping services and many others — or that is submitted to us directly.
The Site is a reference and discovery service. It does not operate as a licensed news outlet or press agency, as a registered social-networking platform, as a marketplace, or as a travel agency, and it is not a representative of any business shown on it.
Acceptance of these Terms
By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site. Creating an account requires explicitly confirming your acceptance.
Definitions
The following terms are used throughout these Terms:
- "Content" — any material presented on the Site.
- "Aggregated Content" — material derived from information published in public sources (including social networks, messaging platforms, mapping and business-directory services, and many others) and processed, translated and structured by us — including items shown in classifieds, rentals, jobs, events, the news & city-digest section, and discussion threads in the community section.
- "Listing" — a card describing a third party's offer, property, job, event, course, place, tour or business.
- "Submission" — material a person sends us for possible publication, including via the submission channel linked from the Site.
Third-party information; no guarantee
Most Content, including Aggregated Content, describes offers, businesses and events of third parties and originates from third-party sources. It is processed automatically — classified, extracted, translated, summarised and scored (see Section 7) — and may be incomplete, outdated or inaccurate.
We do not guarantee the accuracy, completeness or freshness of any Content, including prices, availability, schedules, opening hours, menus, ratings, ownership, licences or contact details, and we do not guarantee the quality, safety, legality or delivery of any goods or services offered by third parties. Verify anything important directly with the counterparty before relying on it, paying money or travelling.
Community discussion and news / city-digest content
The Site includes a community discussion section and a news & city-digest section. Both present Aggregated Content — material and discussion points sourced from public sources and processed, translated and structured by us for presentation. The Site does not currently offer a general public posting, commenting or messaging feature: you cannot create or reply to threads directly on nha-trang.vn.
Any counts, tags or similar figures shown alongside such content are illustrative editorial or aggregate indicators, not a live measurement of on-site user activity, and are provided for general orientation only.
Sections 4, 17 and 18 (no guarantee, moderation, reporting and takedown) apply in full to this content.
We are not a party to your deals
Any contact, negotiation or transaction between you and a seller, landlord, employer, organiser, school, venue or tour operator happens directly between you and them, outside the Site. We are not a party, agent, broker or guarantor of such transactions, receive no payments under them, and bear no responsibility for their performance. The Site itself does not process payments.
Automated (AI-assisted) processing
We use automated tools, including AI models, to classify, extract, translate (into English, Russian, Vietnamese, Chinese and Korean), summarise, tag and score Content, and to produce aggregate summaries of publicly available reviews. Automated output may contain errors and is provided for information only. Scores, badges and summaries reflect our methodology and model output, not objective fact.
Where a page is shown in a language other than its source language, the text is normally a machine translation. Where practical, aggregated or machine-translated Content is marked as such.
No professional advice
Nothing on the Site is legal, visa, medical, financial, real-estate, safety or other professional advice. Emergency and practical information may be outdated — always verify with official sources.
Listings and directory entries
A business, place or offer may appear on the Site without its owner's participation, based on publicly available information. Presence on the Site does not mean partnership, affiliation, endorsement, verification or certification, unless expressly labelled. Contact details shown in a Listing belong to the person who published the original offer.
Corrections, claims and removal
Anyone may report an error or another concern as described in our Content & Takedown Policy. A business owner may claim their listing, correct factual details, provide their own photos (warranting they hold the rights), and request removal on the grounds set out in that policy and in our Business Listings & Awards Policy. Claiming a listing does not give control over editorial assessments, awards or ranking. We aim to respond within 7 working days. Handling a request is not an admission of liability.
Editorial content and awards
Guides, selections, and place shields and awards (such as "Nearo Pick", "Exceptional" or "Nha Trang Icon") are our subjective editorial judgement, made under the methodology published in our Business Listings & Awards Policy. They are not statements of objective fact, are not sold, and may change or be withdrawn at any time.
Advertising and affiliate links
Commercial placements are labelled. Links to Viator and similar partners are affiliate links: if you book through them we may earn a commission from the partner; this does not change your price. Bookings made on partner sites are contracts between you and the partner under the partner's own terms.
Accounts
Browsing the Site does not require an account. Accounts support specific functions (such as submitting content, administration, or claiming a listing) and can be created with an email address and password or via supported social sign-in options. You must provide accurate information, keep your credentials secure, and not impersonate others; you are responsible for activity under your account. We may suspend or delete accounts used in violation of these Terms. You may delete your account at any time by contacting us.
Eligibility
The Site is intended for users aged 16 or older.
Submissions and licence
By sending us a Submission (including via the submission channel linked from the Site) you:
- confirm you have the right to it and that it is truthful and lawful;
- confirm you have the right to share any contact details it contains and agree to their publication for the purpose of responding to your offer;
- grant the Operator a non-exclusive, worldwide, royalty-free licence to store, moderate, edit, format, translate, reproduce and display it on the Site and in the Site's own channels for as long as it remains published, and thereafter as needed for legal compliance and dispute resolution;
- understand that you may request unpublication at any time, and that we may decline or remove any Submission.
Prohibited content and conduct
It is prohibited to submit or use the Site to distribute content that violates Vietnamese law, including:
- content against national security or public order, or false or misleading information;
- fraud, scams or pyramid schemes;
- drugs, weapons, or other illegal goods and services;
- pornography;
- content infringing the intellectual-property, image, privacy or reputation rights of others;
- spam and malware;
- disrupting the Site, bypassing security or moderation, harvesting other users' data, or copying substantial parts of the Site's database.
Moderation
We review Submissions and Aggregated Content using a combination of automated tools and human moderation. We have the right — but, except where the law imposes a specific duty, not a general obligation — to check, edit, refuse, hide, restrict or remove any Content, and to block sources, at our discretion, including to comply with law, court or authority decisions, protect users, or maintain quality. We give reasons where practical.
Reporting and takedown
Reports of unlawful content, personal-data concerns, and intellectual-property complaints are handled under our Content & Takedown Policy. We act on valid notices promptly, including within statutory deadlines where they apply.
Intellectual property
The Site's design, code, branding, editorial texts, methodology, and the selection and arrangement of its database belong to the Operator and are protected by law. Aggregated Content and Submissions belong to their original authors and are used as described in these Terms. You may use the Site for personal, non-commercial reference; systematic extraction or republication of the database requires our written consent.
External links and third-party services
The Site links to third-party resources, such as community chat channels, business websites, map and booking services. These are independent services outside our control; their content and their processing of your data are governed by their own terms.
Availability
The Site is provided "as is" and "as available". We do not warrant uninterrupted or error-free operation and may change, suspend or discontinue any feature, listing, page, ranking or the Site itself at any time without notice.
Liability
To the maximum extent permitted by the law of Vietnam: we are not liable for decisions you make in reliance on Content, including travel, purchase, rental, employment or booking decisions; we are not liable for acts or omissions of third parties, including businesses listed on the Site and operators of linked resources; and we are not liable for indirect or consequential losses or lost profits. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Vietnamese law, including liability for damage caused intentionally, or mandatory consumer-protection and data-protection rights.
Indemnity
If your Submission or your unlawful use of the Site causes a third party to bring a claim against the Operator, you will compensate the documented damage the Operator incurs as a result, to the extent permitted by law.
Force majeure
Neither party is responsible for non-performance caused by circumstances beyond its reasonable control.
Changes to these Terms
We may amend these Terms. The current version and its date are always available on this page; material changes are announced on the Site at least 15 days in advance. Continued use after the effective date constitutes acceptance. Previous versions are available on request.
Governing law and disputes
These Terms are governed by the laws of the Socialist Republic of Vietnam. Disputes are first addressed by negotiation via the contacts below; unresolved disputes are subject to the competent Vietnamese courts at the Operator's registered address, unless mandatory law gives consumers a different venue.
Language versions
These Terms are published in Vietnamese, English, Russian, Chinese and Korean. The Vietnamese, Russian, Chinese and Korean versions are working translations. For now, in case of discrepancies between versions, the English version prevails. Once a certified Vietnamese legal translation is adopted, the Vietnamese version will prevail instead; this page will be updated to reflect that change.
Severability and entire agreement
If any provision of these Terms is found invalid, the remainder stays in force. These Terms, together with the Privacy Policy and the Content & Takedown Policy, form the entire agreement about your use of the Site.
